YOUR PARTNER IN ON-DUTY INJURY CLAIMS

Megan Bartlett Law, APC, represents public safety officers who have experienced accidents and injuries that occurred while on the job.

We take inspiration from the fearlessness, commitment, and diligence that public safety officers show when serving and protecting our communities, and we apply these qualities when representing officers in their personal injury cases.

Civil litigation cases for public safety officers are often complex as officers face inherent dangers in their everyday employment duties. Navigating on-duty injuries caused by third parties requires a deep understanding of the legal system and how these cases fit uniquely within it.

If you’ve been injured on the job, workers’ compensation is not always your only option for seeking recourse. In cases where a negligent third party causes your accident, you may be able to file a claim against them or their insurance company to recover financial damages for your injuries and loss.

I understand the unique challenges that civil litigation cases present for public safety officers, and I’ve made it my mission to represent these officers during their times of need.

ON-DUTY PERSONAL INJURY CLAIMS

Public safety officers who are injured on the job as a result of a third party’s negligence or recklessness can often seek compensation through a personal injury claim in addition to a workers’ compensation claim.

As long as your injury was not caused by a co-worker or your employer, you may be able to recover the following damages in a personal injury claim:

  • Loss of earnings
  • Loss of consortium
  • Pain and suffering
  • Punitive damages

ON-DUTY MOTOR VEHICLE ACCIDENTS

If you are involved in a car accident while on duty, you will typically have three options to pursue compensation – worker’s compensation, the other driver’s insurance company, and your insurance company.

FILE A WORKERS’ COMPENSATION CLAIM

Public safety officers in California will be limited in the types of compensation they can receive in workers’ compensation claims.

This will cover medical treatment and loss of income up to a certain amount, but you cannot receive compensation for a wide range of damages that often accompany on-the-job accidents.

SEEK RECOVERY FROM THE OTHER DRIVER’S INSURANCE COMPANY

In addition to a workers’ compensation claim, you may also be able to file a claim with the at-fault driver’s insurance company to recover the additional compensation needed for losses like overtime pay, loss of future promotion, pain and suffering, and various other losses.

FILE AN UNINSURED/UNDERINSURED MOTORIST CLAIM WITH YOUR INSURANCE PROVIDER

Uninsured/underinsured motorist (UIM) coverage is a valuable third option if the at-fault driver does not have insurance or if their insurance policy does not fully cover your losses. A UIM claim is filed with your insurance provider, even if the accident occurred while in a department vehicle.

California does not require this type of coverage, but it provides valuable protection for motorists who elect to have it.
